Terms of Service

1. Agreement to terms

By creating an account or using Gather360, you agree to be bound by these Terms of Service. If you are using Gather360 on behalf of a business or organisation, you confirm that you have the authority to bind that entity to these terms.

If you do not agree with these terms, please do not use the service.

2. Description of service

Gather360 is a cloud-based customer relationship management (CRM) platform that allows you to manage clients, contacts, notes, documents, follow-ups and team collaboration. The service is provided as a subscription and accessed via a web browser.

3. Accounts

Accounts are not self-serve. You request a demo, we show you the platform, and we then create your account for you using a valid email address. You are responsible for:

• Providing accurate and complete account information.
• Maintaining the security of your account credentials.
• All activity that occurs under your account.
• Notifying us immediately if you suspect unauthorised access.

4. Subscription and billing

Gather360 is a paid subscription from £14.99 per month. There are three plans, and every plan includes every feature — unlimited clients, contacts, notes, follow-ups and document storage. The only difference is how many team members you can have:

• Basic — £14.99 per month, up to 3 users.
• Core — £24.99 per month, up to 5 users.
• Pro — £49.99 per month, unlimited users.

• Subscriptions are billed monthly by invoice, payable by bank transfer within 14 days.
• We do not take or store card details at any point.
• All prices are in GBP and inclusive of VAT where applicable.
• There is no contract or lock-in. You can cancel at any time by emailing us, and cancellation takes effect at the end of your current billing period.
• We do not offer refunds for partial months of service.
• We reserve the right to change pricing with 30 days' notice.

5. Demos and setup

There is no free trial and no self-serve sign-up. Before you commit, we give you a personal demo on a call, walk you through the whole system and answer your questions. If it is a fit, we create your account, set you up as your company's administrator and help you get started. You then invite your own team. There are no contracts, so you can cancel at any time.

6. Acceptable use

You agree to use Gather360 only for lawful purposes and in accordance with these terms. You must not:

• Use the service for any illegal or unauthorised purpose.
• Upload malicious files, viruses or harmful code.
• Attempt to gain unauthorised access to other accounts or our systems.
• Use the service to send spam or unsolicited communications.
• Resell, redistribute or sublicense access to the service without our written consent.
• Reverse engineer, decompile or disassemble any part of the platform.

We reserve the right to suspend or terminate accounts that violate these terms.

7. Your data

You retain ownership of all data you enter into Gather360, including client records, contacts, notes, documents and any other content. We do not claim any ownership rights over your data.

You grant us a limited licence to store, process and display your data solely for the purpose of providing the Gather360 service to you. This licence ends when you delete your data or close your account.

8. Data protection

We take data security seriously. Your data is hosted in the United Kingdom, transmitted over encrypted connections, and isolated from other accounts. We comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

Where you store personal data of your clients or contacts within Gather360, you are the data controller for that data and we act as a data processor on your behalf. You are responsible for ensuring you have a lawful basis to store and process that data.

9. Service availability

We aim to keep Gather360 available at all times but do not guarantee uninterrupted access. The service may be temporarily unavailable due to:

• Scheduled maintenance (we will provide reasonable notice where possible).
• Urgent security updates or patches.
• Factors outside our reasonable control, including hosting provider issues or internet outages.

10. Limitation of liability

To the fullest extent permitted by law:

• Gather360 is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
• We do not warrant that the service will be error-free, secure or uninterrupted.
• Our total liability to you for any claims arising from the use of the service shall not exceed the amount you have paid us in the 12 months preceding the claim.
• We shall not be liable for any indirect, incidental, consequential or special damages, including loss of profits, data or business opportunities.

11. Cancellation and termination

• By you — there is no contract, so you can cancel your subscription at any time by emailing us. You will retain access until the end of your current billing period.
• By us — we may suspend or terminate your account if you breach these terms, fail to pay your subscription, or if we are required to do so by law. We will provide reasonable notice where possible.

Upon termination, your data will be retained for 30 days. After that period, it will be permanently deleted unless you request earlier deletion or we are required to retain it by law.

12. Intellectual property

All rights, title and interest in the Gather360 platform — including the design, code, branding, logos and documentation — belong to Mako Digital. These terms do not grant you any rights to our intellectual property other than the limited right to use the service as described.

13. Changes to these terms

We may update these terms from time to time. If we make significant changes, we will notify you via email or through the platform with at least 30 days' notice. Continued use of the service after changes take effect constitutes acceptance of the new terms.

14. Governing law

These terms are governed by the laws of England and Wales. Any disputes arising from these terms or the use of Gather360 shall be subject to the exclusive jurisdiction of the courts of England and Wales.
